Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Magical Andaman website (magicalandaman.com) and any booking, content, or related services we offer (collectively, the "Services"). By using the Services or making a booking, you agree to these Terms.

1. Who we are

Magical Andaman is operated by TRVL ADVENTURE ESCAPES PVT LTD, a company registered in India. Our GSTIN is stated on your invoice. References to "we", "us", and "our" in these Terms refer to that entity.

2. The role we play

For ferry tickets, hotel stays, day-trip experiences, and other third-party services booked through our website, we act as a booking agent on behalf of the respective service providers (Makruzz, Green Ocean, Nautika, Sealink, hotels, tour operators, etc.). The actual contract for service delivery is between you and that provider. We are not liable for delays, cancellations, accidents, or service failures caused by the provider — though we will help you obtain refunds or rebook where the provider's policies allow.

For custom holiday packages we put together ourselves, we act as the principal — see clause 7 for our liability in those cases.

3. Booking and payment

  • All prices are quoted in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
  • Payment is required in full at the time of booking, unless we have agreed otherwise in writing.
  • Payments are processed through Razorpay or another PCI-DSS-compliant gateway. We do not store your card or bank details.
  • A booking is only confirmed when you receive an e-ticket or written confirmation from us. Until then, the seats / rooms / slots are subject to availability.
  • You are responsible for ensuring that the names, ages, and ID details of all passengers are accurate. Errors discovered after issue may incur correction fees or require rebooking.

4. Government identification

Ferry operators in the Andamans require every adult passenger to carry valid government-issued photo identification (Aadhaar, passport, voter ID, or driving licence) on the day of travel. You are responsible for carrying valid ID. We are not liable for denied boarding due to missing or invalid ID.

5. Cancellation and refunds

Cancellation and refund terms depend on the service provider and are documented in our Refund Policy. Where you cancel a booking, refunds (less any applicable fees) are processed back to the original payment method, usually within 7–10 business days.

6. Schedule changes and disruptions

Ferry timings and routes are subject to change due to weather, sea conditions, or operator decisions. We will notify you of any change as soon as we receive it. Where a service is cancelled by the operator, you are entitled to a free reschedule or full refund per the operator's policy.

7. Limitation of liability

Our total liability to you for any claim arising under these Terms or out of your use of the Services is limited to the amount you have paid us for the booking giving rise to the claim. We are not liable for indirect, incidental, or consequential damages — including loss of enjoyment, missed connections, or accommodation costs caused by third-party service disruptions.

Nothing in these Terms excludes liability for death, personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.

8. User conduct

You agree not to use the Services to (a) commit fraud, (b) infringe anyone's rights, (c) submit false or misleading information, (d) interfere with the operation of the website, or (e) violate any applicable law.

9. Intellectual property

All content on the website (text, images, logos, code) belongs to us or our licensors and is protected by copyright and trade mark laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Privacy

Our handling of your personal information is set out in our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page. Continued use of the Services after a change constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Any disputes arising under or in connection with them are subject to the exclusive jurisdiction of the courts at Port Blair, Andaman & Nicobar Islands.
